Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CyberPsyche service available at app.cyber-psyche.com (the “Service”), operated by Carmen Curtayne (“CyberPsyche”, “we”, “us”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

CyberPsyche is a structured ethical impact assessment platform for AI products. The Service allows registered users to complete a 56-criterion ethical assessment across seven principles, view scores and risk levels in a dashboard, and export assessment results in PDF and CSV formats.

2. Eligibility and accounts

You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Accounts are created via a magic-link email sent to a single, valid email address. You are responsible for maintaining the confidentiality of access to that email account and for all activity that takes place under your account.

The CyberPsyche application — including its source code, user interface, the 56-criterion assessment framework, the seven-principle taxonomy (Autonomy, Opportunity, Privacy, Fairness, Transparency, Accountability, Sustainability), the scoring methodology, the rubrics, the visual design, and all associated marketing and educational materials — is protected by copyright, database rights, trademark law, and trade secret protection.

“CyberPsyche” and the CyberPsyche logo are trademarks of Carmen Curtayne. All other trademarks remain the property of their respective owners.

All rights not expressly granted to you under these Terms are reserved to CyberPsyche.

4. Licence to use the Service

Subject to your continuous compliance with these Terms, CyberPsyche grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Service through its official user interface for your own internal business or evaluation purposes. You retain all rights in the data you input into the Service — including project names, descriptions, business unit names, and your answers to assessment criteria (“Your Content”).

You grant CyberPsyche a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content solely as necessary to provide the Service to you, to generate your assessment scores and exports, and to maintain backups for service continuity.

We do not use Your Content to train models, sell to third parties, or build aggregate data products without your separate, explicit consent.

7. Feedback

Any feedback, suggestions, or ideas you submit about the Service may be used by CyberPsyche without obligation, attribution, or compensation.

8. Service availability and changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. We will use reasonable efforts to provide advance notice of material changes that will affect paying users.

9. Fees and subscription

Access to the Service is provided on a subscription basis. The current plans, features, and prices are set out on our pricing page and at the point of sign-up. By selecting a plan and confirming payment, you agree to pay the applicable fees for that plan.

Billing cycle. Subscriptions are billed in advance on a recurring basis, either monthly or annually depending on the plan you select. The billing cycle begins on the day you activate your subscription and renews automatically on the same day of each subsequent cycle.

Automatic renewal. Your subscription will renew automatically at the end of each billing cycle for the same duration, using the payment method on file, unless you cancel before the renewal date. You authorise CyberPsyche (or its payment processor) to charge that payment method for each renewal.

Cancellation. You may cancel your subscription at any time from within your account settings or by contacting info@cyber-psyche.com. Cancellation takes effect at the end of the current billing cycle — you retain access to the Service until that date and are not charged again thereafter.

Refunds. Fees already paid are non-refundable except where required by applicable law, including the statutory right of withdrawal for consumers in the European Union and United Kingdom (where applicable). We do not provide prorated refunds for unused portions of a billing cycle following cancellation.

Plan changes. You may upgrade or downgrade your plan at any time. Upgrades take effect immediately and are charged on a prorated basis for the remainder of the current billing cycle. Downgrades take effect at the start of the next billing cycle.

Price changes. We may change subscription prices from time to time. We will give you at least thirty (30) days’ advance notice of any price increase affecting your subscription, by email or in-app notification. The new price applies from your next renewal after the notice period. If you do not agree to the new price, you may cancel your subscription before it takes effect.

Failed payments. If a payment fails, we will attempt to charge the payment method on file again over a short retry period. If payment cannot be collected, we may suspend or terminate your access to the Service until the outstanding balance is settled.

Taxes. All fees are stated exclusive of value added tax (VAT) and any other applicable taxes, levies, or duties, which will be added to your invoice at the prevailing rate where required by law.

Free trials and early access. Where we offer a free trial, evaluation period, or early-access tier, the terms, duration, and any conversion to a paid plan will be disclosed at the point of sign-up. Unless stated otherwise, free trials convert to a paid subscription automatically at the end of the trial period using the payment method you provided, unless you cancel before the trial ends.

10. Term and termination

These Terms apply from the moment you first access the Service and continue until terminated. You may terminate at any time by ceasing use of the Service and requesting account deletion via info@cyber-psyche.com.

We may suspend or terminate your access at any time, with or without cause and with or without notice, including for breach of these Terms. Sections 3, 4, 5, 6, 7, 11, 12, 13, 14, and 15 survive termination.

The Service and all assessment outputs are provided “as is” and “as available,” without warranty of any kind, express or implied.

CyberPsyche is not legal, regulatory, or compliance advice. Outputs of the assessment — including numeric scores, risk levels, principle breakdowns, and exported reports — are informational only. They do not constitute:

You and your organisation remain solely responsible for any decision to develop, deploy, modify, suspend, or withdraw an AI system. The CyberPsyche framework draws on publicly available regulatory and ethical guidance, but regulation evolves quickly and assessment content may not reflect the most recent legal developments.

12. Limitation of liability

To the maximum extent permitted by applicable law, CyberPsyche shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or in connection with these Terms or the use of, or inability to use, the Service.

Our aggregate liability under or in connection with these Terms shall not exceed the greater of (a) the amounts paid by you for the Service in the twelve months preceding the event giving rise to liability, or (b) one hundred euros (€100). Nothing limits or excludes liability that cannot be limited or excluded under applicable law.

13. Indemnity

You agree to indemnify and hold harmless CyberPsyche and Carmen Curtayne from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) any AI system you develop, deploy, or operate using outputs from the Service.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, notify you in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of Republic of South Africa, without regard to conflict-of-law principles. The parties submit to the exclusive jurisdiction of the courts of Republic of South Africa.

16. Reporting suspected infringement or misuse

If you believe content from CyberPsyche has been copied, replicated, or used in violation of these Terms, please contact info@cyber-psyche.com.

17. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CyberPsyche concerning the Service. If any provision is held invalid or unenforceable, the remainder remains in full force. Failure to enforce any right is not a waiver.
